La Consulta dà ai cittadini la parola decisiva sulle trivelle

“La Sentenza della Corte Costituzionale, che ha confermato il referendum sulle trivelle sul quesito già “promosso” dalle Corte di Cassazione, ci dà lo spunto per rilanciare richieste chiare al Governo: rigetto immediato e definitivo di tutti i procedimenti ancora pendenti nell’area di interdizione delle 12 miglia dalla costa (a cominciare da Ombrina) e una moratoria di tutte le attività di trivellazione a mare e a terra, sino a quando non sarà definito un Piano energetico nazionale volto alla protezione del clima e rispettoso dei territori e dei mari italiani”. Con questo commento le associazioni ambientaliste Greenpeace, Legambiente, Marevivo, Touring Club italiano e WWF accolgono il giudizio della Consulta, che conferma l’inefficacia del tentativo del governo di scongiurare il referendum sulle trivelle. La decisione della Corte Costituzionale chiarisce come quanto disposto con gli emendamenti alla legge di Stabilità lo scorso dicembre, benché segni un dietro front radicale (e positivo) del governo, non risolva – sulla questione della fascia marina off limits – il conflitto sollevato dalle Regioni contro la strategia fossile del governo Renzi.

Le associazioni ambientaliste fanno notare come la volontà del Governo di tutelare gli interessi dell’economia fossile (con le norme pro trivelle come con gli interventi per bloccare lo sviluppo delle rinnovabili) abbia creato un conflitto istituzionale senza precedenti nel Paese. Pur di assecondare le lobby dei petrolieri, l’esecutivo Renzi aveva promosso forzature inaccettabili, come la classificazione delle trivellazioni come “opere strategiche” (dunque imposte a forza ai territori) e la creazione di servitù potenzialmente senza limiti di tempo, con concessioni prorogabili ad oltranza. Con le modifiche introdotte nella Legge di Stabilità 2016, grazie all’iniziativa referendaria, l’esecutivo di Renzi è stato in larga misura costretto a smentire se stesso.

La Corte Costituzionale oggi respinge di fatto i tentativi furbeschi messi in campo dal governo per eludere il merito della questione delle trivelle entro le 12 miglia; e rimette al giudizio dei cittadini quei meccanismi legislativi truffaldini con cui si è aggirato sino ad oggi un divieto altrimenti chiaro, lasciando campo libero ai petrolieri fin sotto costa.

La Corte Costituzionale ha quindi ritenuto che le affrettate modifiche governative non siano sufficienti e ha rimandato alla volontà popolare la decisione su quelle disposizioni del Decreto Sviluppo del 2012 (decreto legge 83/2012) che fanno salvi non solo i titoli abilitativi già rilasciati all’entrata in vigore della norma (cioè i diritti già acquisiti), ma anche i procedimenti autorizzativi in corso, conseguenti e connessi in essere a fine giugno 2010 nella fascia off limits delle 12 miglia. La modifica voluta dal Governo, pur eliminando la “sanatoria” sui procedimenti in corso, introduce una formula ambigua rispetto alla durata delle concessioni (per la durata di vita utile del giacimento).

Le Associazioni ambientaliste chiedono che nessuna nuova infrastruttura estrattiva possa essere realizzata in deroga a un Piano delle aree, da sottoporre a valutazione ambientale strategica, come stabilito dalla normativa comunitaria. E dichiarano tutto il loro impegno per la campagna referendaria, che da oggi ufficialmente, impegnerà tutte le energie positive del Paese nel tentativo di respingere l’assalto dei petrolieri ai nostri mari e i piani fossili del governo di Roma.
