Italia Nostra. Burchio, hanno vinto i cittadini

Riceviamo dal Consiglio Regionale Marche di Italia Nostra la seguente nota riferita alla vicenda del Burchio di Porto Recanati.

Italia Nostra Marche esprime la propria soddisfazione per la sentenza del Consiglio di Stato (CdS) sulla vicenda del Burchio a Porto Recanati che ha stabilito chi aveva ragione.

Il Consiglio di Stato afferma che la amministrazione comunale del sindaco Ubaldi, nell’approvare la variante a favore della lottizzazione edilizia Coneroblu in località Monterice “ha del tutto omesso di considerare il gravissimo negativo impatto che l’opera avrebbe avuto sul delicato equilibrio del proprio territorio e così facendo, “ha esercitato male la pur ampia discrezionalità in materia urbanistica e ha adottato una delibera illegittima!”

E’ da sottolineare il riconoscimento del CdS all’appropriato intervento, contrario al progetto, della Soprintendenza retta dall’apprezzato arch. Stefano Gizzi.

Bene ha fatto quindi la successiva amministrazione del sindaco Montali a proporre al nuovo consiglio Comunale di annullare, in autotutela, la delibera dell’ex sindaco Ubaldi e ben ha fatto il Commissario Prefettizio ad impugnare davanti al Consiglio di Stato la sentenza del Tar Marche, come richiesto da Italia Nostra.

Per quanto riguarda il risarcimento da versare alla ditta Coneroblu per “la condotta complessiva del comune (amministrazione Ubaldi ndr ) che ha ingenerato nella società un legittimo affidamento circa la legittimità della procedura seguita”, il Comune di Porto Recanati, a nostro parere, dovrà rivalersi economicamente sull’ex sindaco Ubaldi e sui precedenti consiglieri comunali che hanno approvato la delibera di variante proposta dalla Ubaldi, consiglieri che così facendo hanno condiviso con la ex sindaco la responsabilità di adottare una delibera illegittima con tutte le sue conseguenze economiche.

Per cui sarà doveroso interessare la Corte dei Conti.

I cittadini di Porto Recanati e tutti coloro che si sono battuti contro la cementificazione del loro territorio hanno vinto e possono stare tranquilli.

Chi ha perso, oltre la Coneroblu e tutti i suoi consulenti di varia estrazione politica, sono gli ex amministratori pubblici che ora dovranno pagare in solido i propri errori.

Chiarito tutto e restituito  l’onore all’ ex sindaco Montali ed alla sua amministrazione, “abbattuta” per essersi opposta al Burchio dal tradimento di un partito della sua maggioranza, si auspica che i cittadini eleggano una nuova amministrazione coesa, fatta di persone capaci ed intenzionate a difendere il territorio, senza “se” e senza “ma”.
